Warranty
Below is the
standard warranty for Kut-Wel Corporation
EFFECTIVE DATE:
July 1, 1999
Equipment sold
by Kut-Wel Corporation is covered under the warranties set forth
in the following paragraphs. Such warranties are extended only
with respect to new and rebuilt equipment purchased directly from
Kut-Wel Corporation, not used or "as is" equipment. In addition,
such warranties are extended only to the first buyer of the equipment
is purchased other than the purpose of resale.
The equipment
is warranted to the buyer to be in good condition and free from
functional defects in materials and workmanship for the designated
warranty period, providing that (1) the equipment is properly installed
and operated under conditions of normal use and (2) regular manufacturer
recommended periodic maintenance and services are performed. Notwithstanding
the above, all parts and equipment which are expendable are only
warranted to be free from functional defects in materials and workmanship
at the time of original delivery at the buyers location.
The foregoing
warranties shall not apply if the equipment has been (a) serviced
or repaired other than by by Kut-Wel Corporation, or by a service
facility not designated by Kut-Wel Corporation., (b) altered by
anyone other than Kut-Wel Corporation, or a non factory-authorized
facility, or (c) subject to abuse, misuse, negligence, or accident,
including use of the equipment other than in the intended manner.
The manufacturer's
sole and exclusive obligation and buyers sole and exclusive remedy
under the warranties is limited to the repair or replacement, free
of charge, at the manufacturer's sole option, of the defective
equipment or part. In order to initiate warranty service the defective
part or equipment must be reported to Kut-Wel Corporation. Where
appropriate and where properly authorized by manufacturers, defective
parts or equipment may be returned under their returned goods policy.
The buyer will supply a purchase order and return the equipment
to Kut-Wel Corporation. or directly to the manufacturer for warranty
at the discretion of Kut-Wel Corporation. The transportation costs
will be the responsibility of the buyer to both Kut-Wel Corporation.
and the manufacturer to and from the buyer's location. The buyer
will be billed as a normal purchase and upon receipt of credit
from manufacturer, the buyer will be credited for the part only.
If the part or equipment is found not to comply with the standard
warranty, the buyer will be responsible for payment and/or replacement
of the part or equipment. Designated equipment not suitable for
return can be repaired under warranty on site.
To initiate warranty
service work a purchase order is also required. The nameplate information
is consisting of model number, serial number and date are required
for proper identification. Following are the warranty periods.

All warranted
service calls will be evaluated for coverage under warranty. The
buyer will always be responsible for all travel and expenses incurred.
The buyer can still be billed for travel time to and from a location
and labor unless specified prior to a service site visit. The service
visits that do not fall under warranty will be billed at our regular
service rates of $99.00 per hour on-site labor and $85.00 per hour
travel time (portal to portal).
KUT-WEL CORPORATION
SHALL NOT BE OTHERWISE LIABLE FOR ANY DAMAGES INCLUDING BUT NOT
LIMITED TO (A) INCIDENTAL DAMAGES, CONSEQUENTIAL DAMAGES, INDIRECT
DAMAGES AND SPECIAL DAMAGES, INCLUDING BUT NOT LIMITED TO ANY LOST
PROFITS INCURRED BY THE BUYER, EVEN IF KUT-WEL CORPORATION HAS
BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR (B) ANY DAMAGES
ARISING OUT OF A CLAIM AGAINST THE BUYER BY ANY OTHER PARTY. THERE
ARE NO EXPRESS OR IMPLIED WARRANTIES THAT EXTEND BEYOND THE WARRANTIES
SET FORTH IN THIS STANDARD WARRANTY. WITHOUT LIMITING THE GENERALITY
OF THE FOREGOING, KUT-WEL CORPORATION DISCLAIMS ALL IMPLIED WARRANTIES,
INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OR MERCHANTABILITY
AND FITNESS FOR A PARTICULAR PURPOSE WITH RESPECT TO THE EQUIPMENT
OR PARTS THEREOF. |
